Stephanie first moved to Kamloops to attend TRU Law School. After graduation, she returned to her hometown of Prince George to article at a large local firm, beginning her solicitor law practice there. An avid gardener, Stephanie was naturally drawn back to the southern interior and all the outdoor opportunities it offers. Away from the office, Stephanie enjoys spending time with her husband, exploring the outdoors with their dog, Morris, an Australian Shepherd.

This course is intended primarily for notaries and lawyers for whom drafting wills is an important part of their practice, but other professionals are encouraged to attend if interested. The goal is to bring attendees up to date on important developments in wills, estates and succession law over the last several years, including significant new cases on assets held in joint tenancy, rights to life insurance policies (and other designated beneficiary assets), and the trend of blended families driving estate disputes. The discussion will focus, in each section, on some practical advice for avoiding or minimizing the risk of these sorts of disputes in the estate planning.

Seminar – Avoiding Disputes (Wills Variation Act Claims)

Join our Wills & Estates Team at our next free seminar for professionals, taking place on Thursday, February 21, 2019 from 9:00 – 11:00 am at the Sandman Signature Hotel (225 Lorne Street, Kamloops, BC).

In our seminar, we will address some of the most common, avoidable causes of wills variation challenges, and how preventative planning could have avoided these costly and often unnecessary disputes.  We will also discuss other types of litigation that are beginning to arise with increasing frequency, such as claims over:

  • Assets passing outside the estate, including tax liability for such assets
  • The actions of a person acting with power of attorney
  • The validity of a non-will estate planning tool such as a gift, joint tenancy transfer, or beneficiary designation

Agenda:
1st Hour:  We will go over the topics noted above, including providing examples/sample client scenarios and giving you tips for dealing with questions clients may ask.
2nd Hour: Open Forum – we will again be answering your Top 10 estate-related questions.

Robert Smithson

Beginning his legal career as in-house counsel for a major trade union, Robert soon moved to the employer side of the labour fence.  He has also spent time as a human resources/industrial relations executive in private industry (Western Star Trucks), a partner at a large firm, and a sole practitioner. Now exclusively representing employers, Robert’s varied background with workplaces of all shapes and sizes – and his unique perspective gained from in-house work for the Teamsters Union – provides his clients with comprehensive, valuable insights into any workplace challenges.

Robert knows that his clients’ main focus is making a living, and that workplace issues need to be resolved quickly. Always focused on keeping his clients out of litigation, Robert applies pro-active strategies to minimize the disruption and costs of civil claims and administrative complaints, to reduce stress for everyone involved. Robert advises clients in private industry as well as in the municipal, academic, and non-profit environments, both unionized and non-unionized.

Partial to the coast and the Island, Robert imagines living by the seashore again one day but he also loves interior BC hiking, particularly in the Okanagan hills. When he’s not exploring, Robert is a guitar player and a (reluctant) singer – you’ll find him running a classic rock jam session in Kelowna.

Alex Johnston

Emily Dolny

Confident in her resolve to use creative solutions, Emily chooses to approach both her life and the law with an inquisitive curiosity. After speaking with Emily for even five minutes, you’ll likely find out that she LOVES animals, specifically her Nova Scotia Duck Tolling Retriever, Jasper, whom she refers to as her “pandemic baby.” Born and raised in Vancouver, Emily is a people person, who enjoys listening to and uplifting anyone in her circles, or engaging in a spirited hockey debate at a family event.

Caleigh Treissman

Always seeking a deeper understanding of life and law, Caleigh is an intuitive thinker who innately develops a thorough understanding of situations and of people. Applying this perspective to her work, Caleigh combines her insight with legal reasoning to direct creative, confident solutions, grounded in her comprehensive understanding of that situation’s unique facts, however nuanced.

Focusing her legal practice exclusively in local government law, Caleigh advises on bylaw challenges and enforcement, governance and operations, municipal liability and risk management. Having spent her first year after law school as a law clerk at the BC Supreme Court, Caleigh has unique knowledge of the court process and insight into judicial decision making. With an ever-proactive approach, Caleigh’s unique experience and her dedication to revealing the best solution through the practical application of the law, allows her clients to visualize the clear answers she provides.

Outside of the office, Caleigh loves skiing, whether it be downhill, water, or cross country. If she’s not honing her skills on the slopes or the lake, Caleigh is likely finding some way to spend more time in the great outdoors, especially if it involves hiking, or her family, friends, and dog, Jib.
